PCLDF Policy
PCLDF – Definitions, Use, and Notices
1) Purpose
This section of the DisplayX Policies is intended to explain our internal classification PCLDF and to set out how DisplayX may use certain third-party design files that are publicly available online. This policy also outlines key terms relating to intellectual property, licensing, customer rights, and third-party claims.
2) Definitions
In this policy, the following definitions apply:
DisplayX, we, us, our means DisplayX and any related entity or trading name used by DisplayX from time to time.
Customer, you, your means any person who purchases, receives, installs, or uses a product supplied by DisplayX.
Design File means any digital design content, including (without limitation) STL/3MF/STEP/CAD files or equivalent formats, whether modified or unmodified.
Licence Terms means the permissions, restrictions, conditions, and requirements stated by the creator/uploader and/or the platform on which a Design File is made available, including any Creative Commons, marketplace licence, “commercial use permitted” statement, or similar permission framework.
PCLDF means Public Commercial Licensed Design File, as defined in clause 3.
3) What is a PCLDF?
PCLDF (Public Commercial Licensed Design File) is DisplayX’s internal classification for a Design File that meets all of the following criteria (as reasonably assessed by DisplayX at the relevant time):
The Design File is publicly available via the internet (including via repositories, forums, or marketplaces), and
The relevant Licence Terms expressly permit commercial use (i.e., manufacturing and selling physical items derived from the file), whether with or without conditions, and
DisplayX has determined, acting reasonably, that manufacturing a physical product from the Design File is appropriate for our product range and quality standards.
Where applicable, product listings may include a notice such as:
“This product is manufactured using a PCLDF. See our Policies page for definitions and licensing details.”
4) Nature of the Product Supplied
Where a product is described as being made using a PCLDF:
DisplayX supplies a physical product only (unless explicitly stated otherwise).
No sale, transfer, assignment, or sublicence of the underlying Design File is provided to the Customer by default.
The Customer is not purchasing ownership of the Design File, nor any intellectual property rights in the Design File, except to the extent required by applicable consumer law and/or expressly granted in writing by DisplayX.
5) Third-Party Rights, IP, and Trademarks
(a) Third-Party Ownership: PCLDF designs may originate from third parties. DisplayX does not claim ownership of third-party designs except to the extent we have independently created modifications or original components.
(b) Trademarks and Brand References: Any names, trademarks, product names, or references (including, without limitation, LEGO®) remain the property of their respective owners. Unless explicitly stated, DisplayX is not affiliated with, sponsored by, or endorsed by any trademark holder.
(c) Compatibility Statements: References to product compatibility are descriptive only and used to help customers understand intended use. They do not imply authorisation, partnership, or endorsement.
6) Licence Assessment and Ongoing Changes
(a) Reasonable Assessment: DisplayX uses PCLDF classification based on a reasonable review of Licence Terms available at the time we source and/or manufacture a product.
(b) Licence Changes: Licence Terms may change over time (including after a product is listed or sold). DisplayX does not control third-party platforms or creators, and we cannot guarantee that any Design File’s Licence Terms will remain unchanged.
(c) No Warranty of Licence Permanence: To the maximum extent permitted by law, DisplayX makes no representation or warranty that a third-party licence will remain valid, unchanged, or enforceable.
7) Modifications, Manufacturing, and Quality Control
(a) Manufacturing Process: DisplayX may adjust or refine a product derived from a PCLDF to improve fitment, strength, printability, finish, or usability. Such adjustments do not necessarily change the underlying licensing status of the original Design File.
(b) Quality Control: Regardless of design origin, DisplayX applies its own manufacturing standards, material choices, and inspection processes.
8) Claims by Original Creators / Takedown Requests
If you are the original creator or rights holder of a Design File that DisplayX has referenced as a PCLDF, and you believe:
the file was not correctly licensed for commercial use, or
your rights have been infringed, or
our listing contains inaccurate attribution or licensing statements,
please contact us with sufficient detail to allow us to review the claim (e.g., link to the file, the applicable licence text, proof of authorship/rights, and the specific concern). We will review and respond within a reasonable timeframe.
Contact: contact@displayx.co.nz
DisplayX may, at its discretion and without admission of liability, take steps including (without limitation) updating listing language, pausing sales, removing a product, or seeking clarification from the uploader/creator.
9) Limitation of Customer Reliance
To the maximum extent permitted by law:
Customers should not rely on the term PCLDF as a guarantee of any particular licensing outcome beyond DisplayX’s reasonable assessment at the time of classification.
DisplayX does not provide legal advice regarding licensing, intellectual property, or third-party rights.
10) Reservation of Rights
DisplayX reserves the right to:
update or withdraw the PCLDF classification,
amend this policy at any time, and
change product availability based on licensing updates, supplier changes, quality considerations, or legal risk management.
11) Governing Law
Unless otherwise required by mandatory consumer protection laws, this policy and any disputes arising in relation to it are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the New Zealand courts.
